Important

• Under Standard licence, the project can be resold to 1 CLIENT for each purchased licence.
• Under Extended licence, the projects can be resold to an UNLIMITED number of CLIENTS.

Definitions

Project : Any unique creation including the Creative Lune product requiring a substantial work to be achieved.

Unlimited use : No limit with the number of projects including the Creative Lune product.

Non-commercial use : The project cannot be resold and its exploitation cannot be remunerated.

Commercial use : The project can be resold and its exploitation can be remunerated.

Physical copy : Each unit of a support containing the project ( e.g., disc, USB drive, poster, etc ).

Download : Each instance of the download of a project.

Boradcast in a show or advertising on TV or Radio :
non-commercial : No personal financial profit can be made with the broadcast of the project ( e.g., teaching film, charity organizasion message, etc ).
commercial : ■ show = The project is invoiced for the production of a program ( e.g., sound design or visual presentation of a sequence, etc ).
■ advertising = The use of the project is done within the framework of a marketing ( e.g., sale of an industrial good, promotion of a show, etc ).

Broadcast not remunerated  film in movie theatre or play in playhouse : The project is screened or used for the stage in a play in front of a public enjoying the show for free. The holder of the licence cannot be remunerated for this broadcast.

Broadcast remunerated  film in movie theatre or play in playhouse : The project is screened or used for the stage in a play in front of a paying audience charged for attending the show (e.g., entry ticket, VOD, streaming, DVD, Blu-ray, etc) . The holder of the licence can be remunerated for this broadcast.

Broadcast in retail outlet* : Sound design or visual presentation of a dedicated space for business ( e.g., store, restaurant, shopping mall, professionnal fair of exhibitors, etc ).
*The “Standard” and “Extended” licenses allow the broadcasting in an unlimited number of places only if each of those places are contractually bound to the person or the body having bought the license.

Web broadcast :
■ non commercial = The project is shown on the web and doesn’t generate any personal financial profit (e.g., non-monetized video, personal blog, etc)
■ commercial =  The project is shown on the web, it generates a financial profit (e.g., monetized video, e-commerce presentation, commercial advertising, etc)

TESTING : Private and not broadcasted use of a project with the aim of confirming or cancelling a choice of product before purchase.

The project can be shown on all Internet platforms except those excluded by our restrictive list ( see restrictions ).

the use of the card occurs without pecuniary gain but :
with this license, I can print up to 50 000 copies. If I want to edit the file to a higher number of copies, I choose the appropriate license.

I choose «Standard» license because :
the use of the poster occurs in the context of my professional business and is a part of a work for which I am paid.

I’m looking for stationery items to print and sale in one or several stores.
I choose «Extended» license because :
the use of the design concerns a gainful activity and applies to an unlimited number of clients.
With this license, I can print to a unlimited number of copies.

 

Music

 

I am a student in a film academy.
I’m looking for a music to illustrate a film in a school context.
I choose «Personal» license because :
the use of the product does not concern a gainful project and will not occur in any commercial broadcast.

I am a videographer.
I’m looking for a music to include in a video project for a client.
I choose «Standard» license because :
the use of the product occurs in the context of my professional business and is a part of a work for which I am paid.

I am a director of documentary movies.
I’m looking for a music for one of my films which is going to be broadcasted in cinema.

To be noted

The products sold on creativelune.com, although royalty free, remain the whole and exclusive intellectual property of the co-founders M. C. Kerzan and J. M. Griers.
They cannot in any case be resold alone without any modification nor can they be included in a bundle, in their original state, whatever the purchased licence.
The licenses “personal”, “standard” and “extended” do not grant an exclusive right of exploitation of the product bought on creativelune.com.

The license has an unlimited period of validity as long as its user respects the terms inherent to it.
A license can be shared only within one same structure or one same group (company, association, etc).
A Creative Lune product cannot be transferred to a third party not holding his own license for it.

Restrictions

The use of Creative Lune products is strictly prohibited in the following cases:
– Pornography
– Publicity for dating websites or agencies, escort services
– Political causes
– Religious proselytizing

The use of our images on social networks is possible in the following cases:
– If the size of posting is lower than 800 X 800 pixels
– If information of copyright appears directly on the image

The musical files for demonstration (downloadable) can only be used for TESTING purpose before purchase.
